Medfoxes – Legal Policies

By accessing or using the website www.medfoxes.com (the “Platform”), purchasing any course, recording, quiz, or live session (“Content” or “Course”), or registering an account, you (“User,” “Student,” or “You”) expressly agree to be bound by the entirety of this Comprehensive Policy.

1. Acceptance and Definitions

2. Eligibility, Governing Law, and Professional Disclaimer

2.1. Eligibility: The Platform is intended for use by medical professionals, paramedics, and students seeking medical education. You must be at least 18 years of age or the age of majority in your jurisdiction to purchase services. If you are under this age, you must have express parental or guardian consent.

2.2. Governing Law and Jurisdiction: This Policy shall be governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Tamil Nadu, India. However, this jurisdiction does not limit any mandatory consumer protection rights you may have in your country of residence. Parties agree to attempt mediation or arbitration before litigation.

2.3. Educational Purpose Only (Critical Disclaimer):

  • The Content is for educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment, nor does it replace official organizational or governmental clinical protocols.

  • MedFoxes does not provide medical advice. Users/Students are solely responsible for their clinical practice, professional decisions, and verification of all information against their own local and regulatory standards. MedFoxes expressly disclaims all liability for any decisions made based on the Content.

  • The Platform is provided “as is,” and MedFoxes disclaims all implied warranties to the maximum extent permitted by law.

Part II: Terms of Sale, Account Access, and Intellectual Property

3. User Accounts and Obligations

3.1. Account Registration: You agree to provide accurate, current, and complete information. Your purchased course access is personal, non-transferable, and non-sharable and is valid for the duration specified at the time of purchase.

3.2. Prohibited Conduct: You shall not copy, download, record, stream-rip, modify, reproduce, or redistribute the Content outside of the intended Platform use. You must not engage in harassment, post illegal content, or attempt to compromise the security of the Platform.

4. Intellectual Property Rights (IPR)

4.1. Ownership: All Content (including videos, text, quizzes, graphics, and branding) is the exclusive property of MedFoxes or its licensors and is protected by Indian and international copyright laws.

4.2. Limited License: Upon purchase, the Student receives a limited, non-exclusive, non-transferable license to access and view the purchased Course Content solely for personal, non-commercial educational purposes.

4.3. Prohibition on Unauthorized Sharing/Recording: Any unauthorized recording (audio or video) or live streaming of live courses or one-on-one sessions is a material breach of this policy and is subject to immediate account termination without refund, in addition to potential civil and criminal penalties under copyright law.

5. Payments and Billing

5.1. Payments: Payments are processed through third-party Payment Gateways (e.g., Stripe, PayPal). MedFoxes is not responsible for the independent terms or security of these Gateways. Prices are in USD, INR or applicable currencies, excluding taxes. You are responsible for any bank fees, currency conversion charges, or local taxes.

Part III: Cancellation, Refund, and Event Policy (The 48-Hour Rule)

6. Refund Policy for Digital/Recorded Courses

6.1. General Refund Condition (Waiver of Withdrawal Right): A purchase of Digital/Recorded Courses (“Courses”) is deemed final and non-refundable except under the specific conditions outlined here. By purchasing and accessing any digital content, the User acknowledges and expressly agrees that the statutory right of withdrawal/cancellation (where applicable, such as under EU/UK consumer laws) is waived at the earliest of the following two events:

  1. Completion of the 48-Hour Refund Period: 48 hours have elapsed from the original time of purchase.

  2. Substantial Content Consumption: The User has accessed or consumed beyond the 10% threshold of the purchased Course Content, as measured by our Platform’s tracking metrics.

6.2. The 10% Consumption Threshold: A full refund is only available if ALL of the following criteria are met:

  • The refund request is initiated via email to edumedfoxes@medfoxes.com within 48 hours of the original purchase time.

  • The total content accessed by the User is less than ten percent (10%) of the entire Course (measured by total video time, slides opened, etc.).

  • Zero (0) attempts have been made on any graded or non-graded quiz or assessment.

  • Zero (0) associated course materials, handouts, or documents have been downloaded.

7. Event-Specific (Live Course & One-on-One) Rules

7.1. Live Group Courses (Scheduled Events):

  • Cancellation more than 48 hours before the Event Start Time: Full refund provided.

  • Cancellation between 24 and 48 hours before the Event Start Time: 50% refund provided.

  • Cancellation less than 24 hours before the Event Start Time or No-Show: No refund provided.

7.2. One-on-One Sessions:

  • A full refund is available only if the session is cancelled 48 hours prior to the scheduled time. Non-refundable once completed or missed.

7.3. Course Cancellation by MedFoxes: If MedFoxes must cancel a scheduled Event, a full refund or the option to reschedule/transfer will be provided.

7.4. Processing: Approved refunds will be processed back to the original payment method within 7 to 14 business days.

Part IV: Global Privacy and Data Protection Policy
